§ 1 Scope

These General Terms and Conditions apply to all orders placed by consumers and entrepreneurs via the online shop of Amore di Me Italy, owner: Sarah Gläser, Claubergstraße 8, 47051 Duisburg, E-mail: info@amoredime.com (hereinafter referred to as the Seller).

A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

§ 2 Offer and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).

By clicking the order button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by e-mail immediately after the order has been placed (acknowledgement of receipt). The purchase contract is not yet concluded with this e-mail.

A purchase contract is only concluded when we accept your order by a separate e-mail (order confirmation) or ship the goods.

§ 3 Prices and Shipping Costs

All prices stated are final prices in Euro and include – where legally required – the statutory value-added tax.

The applicable shipping costs will be shown separately during the ordering process and must be borne by the buyer, unless free shipping has been agreed.

For international deliveries (outside the EU), additional customs duties, taxes and fees may apply, which must be borne by the recipient.

§ 4 Terms of Payment

The following payment methods are available:

• Credit card (Visa, Mastercard, American Express)
• PayPal
• Klarna

The invoice amount is due and payable upon conclusion of the contract. We reserve the right to restrict certain payment methods depending on the country of delivery.

§ 5 Delivery and Delivery Time

We deliver worldwide. The delivery time is generally 3–5 working days within Germany and 7–21 working days for international deliveries, unless otherwise stated.

Should an ordered product not be available, we will inform you immediately. Payments already made will be refunded immediately in this case.

The seller bears the shipping risk if the buyer is a consumer.

§ 6 Retention of Title

The delivered goods remain the property of the seller until full payment of the purchase price.

§ 7 Warranty and Liability for Defects

The statutory warranty rights apply. The warranty period for new goods for consumers is two years from delivery of the goods.

Our products are made of high-quality, organic silk (Made in Italy). Care instructions can be found in the product descriptions. Damage caused by improper handling or care is not covered by the warranty.

§ 8 Limitation of Liability

Claims for damages by the buyer are excluded. Excluded are claims for damages resulting from injury to life, limb, health or from the violation of essential contractual obligations, as well as liability for other damages based on an intentional or grossly negligent breach of duty by the seller or his vicarious agents.

§ 9 Dispute Resolution

We are not willing or obliged to participate in a dispute resolution procedure before a consumer arbitration board.

§ 10 Applicable Law and Place of Jurisdiction

The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer protection regulations of the country in which the consumer has his habitual residence apply to consumers.
